1. Introduction

Welcome to Reef Adventures. These Terms of Service ("Terms") govern your use of the Reef Adventures website (the "Site") and all services offered by Reef Adventures, including but not limited to diving expeditions, educational programs, and conservation activities (collectively, the "Services").

By accessing or using our Site and Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Site or Services.

2. Eligibility

You must be at least 18 years old to use our Services independently. Users under 18 may use our Services only with the involvement and consent of a parent or legal guardian. Certain diving activities may have additional age and certification requirements as specified during the booking process.

3. Account Registration

When you create an account with us, you guarantee that the information you provide is accurate, complete, and current at all times. Inaccurate, incomplete, or obsolete information may result in the immediate termination of your account.

You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer or device. You agree to accept responsibility for all activities that occur under your account or password.

4. Booking and Cancellation Policy

All bookings for diving expeditions and other activities are subject to availability and confirmation. A booking is not confirmed until you receive a written confirmation from Reef Adventures.

Our cancellation policy is as follows:

  • Cancellations made 30 days or more before the scheduled activity date: Full refund minus a 10% administrative fee
  • Cancellations made 15-29 days before the scheduled activity date: 50% refund
  • Cancellations made 14 days or less before the scheduled activity date: No refund

Reef Adventures reserves the right to cancel any activity due to adverse weather conditions, insufficient participants, or any other circumstances that may affect safety. In such cases, you will be offered an alternative date or a full refund.

5. Health and Safety Requirements

Participants in diving activities must complete a medical questionnaire and may be required to provide a medical certificate of fitness for diving. You must disclose any medical conditions that may affect your ability to dive safely.

All participants must follow the safety instructions provided by Reef Adventures staff at all times. Reef Adventures reserves the right to refuse service to anyone deemed unfit for participation in an activity for health, safety, or other reasons.

6. Intellectual Property

The content on our Site, including text, graphics, logos, images, audio clips, and software, is owned by Reef Adventures and is protected by copyright, trademark, and other intellectual property laws.

You may access, download, and print content from our Site for your personal, non-commercial use only. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information obtained from our Site without our prior written permission.

7. User Content

By submitting content to our Site (including reviews, photos, and comments), you grant Reef Adventures a worldwide, non-exclusive, royalty-free license to use, reproduce, adapt, publish, translate, and distribute your content in any existing or future media formats.

You represent and warrant that your content does not violate any third-party rights, including copyright, trademark, privacy, or other personal or proprietary rights. You also warrant that your content is not unlawful, defamatory, or otherwise objectionable.

8. Limitation of Liability

Reef Adventures and its directors, employees, partners, agents, suppliers, or affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Site or Services.

To the maximum extent permitted by applicable law, Reef Adventures' total liability for any claims arising from these Terms or your use of our Site or Services, whether in contract, tort, or otherwise, is limited to the amount you paid to Reef Adventures for the Services giving rise to the claim.

9. Indemnification

You agree to defend, indemnify, and hold harmless Reef Adventures and its employees, contractors, agents, officers, and directors from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from your use of and access to the Site or Services, your violation of these Terms, or your violation of any third-party rights.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of Queensland, Australia, without regard to its conflict of law provisions.

Any disputes relating to these Terms shall be subject to the exclusive jurisdiction of the courts of Queensland, Australia.

11. Changes to Terms

Reef Adventures reserves the right to modify or replace these Terms at any time. We will provide notice of any changes by updating the "Last Updated" date at the top of these Terms.

Your continued use of the Site or Services after any such changes constitutes your acceptance of the new Terms. If you do not agree to the new Terms, please stop using the Site and Services.
